The attorney-general now urges Supreme Court approval on armed-struggle grounds, so Sami Abu Shehadeh’s final exclusion by Election Day is likely.

The attorney-general’s explicit request for approval, the committee’s overwhelming vote and Deputy Supreme Court President Noam Sohlberg’s support make a final ban likely. The major counterweight is the Supreme Court’s historically narrow interpretation of Section 7A, including repeated reversals of Balad bans and a preference for sustained conduct over isolated statements. This case nevertheless presents stronger institutional support and potentially broader evidence than those precedents.

Points to YES

The attorney-general’s request for Supreme Court approval gives the armed-struggle case powerful institutional support.
On September 29, Attorney-General Gali Baharav-Miara asked the Supreme Court to approve Abu Shehadeh’s disqualification specifically on the armed-struggle ground.
The committee decision was overwhelming and included unusual support from its senior judicial chairman.
On September 23, the Central Elections Committee voted 31–4 to bar Abu Shehadeh, with Deputy Supreme Court President Noam Sohlberg joining the majority.
A newly submitted recording could broaden the case beyond the article at its center.
On September 29, Otzma Yehudit submitted a recording allegedly showing Abu Shehadeh describing Hamas’s war effort as “steadfastness” and “legendary.”

Points to NO

Supreme Court precedent strongly disfavors candidate disqualification under Section 7A.
A September 29 review found that the Supreme Court had upheld only one Central Elections Committee disqualification since the relevant 1985 amendment.
The governing legal standard generally demands a sustained pattern rather than one isolated statement.
On September 23, reporting noted that the Supreme Court interprets Section 7A narrowly and generally requires a sustained pattern rather than an isolated statement.
